Wrongly accused man files for compensation

Darry Luke Borg, the man who was mistakenly arraigned and accused of a hold-up in Birkirkara, this morning filed an application in the Constitutional Court requesting compensation for his arrest and detention for three days. The application was filed against the Attorney General, the Director of the Law Courts and the Police Commissioner. Borg was arraigned on Wednesday last week and accused of carrying out a hold-up at The Convenience Store in Birkirkara. He was held in remand of three days, when another man was arraigned and admitted to the crime, in which no-one else was involved. The case was dropped yesterday. In his application Borg said he should never have been arraigned under arrest because there was never any reasonable suspicion in him. He should never have been denied bail, and the police should have dropped their case against him on Friday, when another man owned up to the crime. Borg also called on the court to declare that his human rights had been breached. The actions of the Police are currently being investigated by the Police Board, which held another meeting today. Borg was invited to testify.
