Enemalta has refused to reveal the names of companies awarded oil procurement tenders over the past 20 years, despite a Freedom of Information request.
The corporation had already refused to disclose this information last week due to “commercial sensitivity”.
But after a new request by The Times under the Freedom of Information Act, the reason for withholding the information changed, with Enemalta now saying the information could be prejudicial.
The requests were made in the context of allegations of illegal commissions awarded for oil procurement contracts.
Enemalta quoted article 30 (2) which states that a document can be withheld if it can “reasonably be expected to prejudice the fair trial of a person”.
The Times is challenging Enemalta’s refusal through a review procedure.
